Welcome to the Surviving a Sagittarius website (the “Site”), operated by Surviving a Sagittarius (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the Site, including any merchandise purchases, content submissions, and interactions with our services. By accessing or using the Site, you agree to these Terms.

ELIGIBILITY 

You must be at least 18 years old, or the age of majority in your jurisdiction, to make purchases on the Site. If you are under 18, you may use the Site only with the involvement and consent of a parent or legal guardian.

CHANGES TO THESE TERMS 

We may update these Terms from time to time. The “Last Updated” date above reflects the latest revision. Continued use of the Site after changes become effective constitutes acceptance of the updated Terms.

PRODUCTS AND MERCHANDISE 

We may offer apparel, accessories, and other merchandise to support the Surviving a Sagittarius brand and show.

All product descriptions, images, sizing information, and prices are provided in good faith but may contain errors or omissions. We reserve the right to correct inaccuracies and update information without prior notice.

Availability is not guaranteed. We may limit quantities, discontinue products, or refuse orders at our discretion.

PRICING, PAYMENT, AND TAXES 

Prices are listed in U.S. dollars unless otherwise stated.

Payments are processed through third-party payment providers. We do not store complete payment card information on our servers.

Applicable sales tax, VAT, or other taxes may be added at checkout where required by law.

SHIPPING, DELIVERY, RETURNS, AND REFUNDS

Shipping times are estimates and may vary.

Risk of loss transfers to you upon delivery to the carrier or delivery address, subject to applicable law.

Return and refund policies should be described on a separate Returns/Refund Policy page and are incorporated into these Terms by reference

INTELLECTUAL PROPERTY 

The name “Surviving a Sagittarius,” logos, graphics, artwork, designs, audio, video, text, photographs, and other content on the Site are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

No ownership rights are transferred to you. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, or commercially exploit Site content without our prior written permission.

Use of the “Surviving a Sagittarius” name or logo in a manner that suggests sponsorship, endorsement, or affiliation without permission is prohibited.

USER SUBMISSIONS AND CONTENT 

If you submit comments, messages, photos, videos, recordings, testimonials, event footage, or other content (“User Content”) to us, including through social media tags, contact forms, or media coverage submissions, you grant us a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, edit, adapt, publish, display, distribute, and promote that User Content in connection with the Surviving a Sagittarius brand, show, website, social channels, and promotional materials.

You represent that:
(a) you own or have the necessary rights to the User Content;
(b) the User Content does not infringe third-party rights; and
(c) the User Content is not unlawful, defamatory, harassing, threatening, hateful, or otherwise objectionable.

We may remove User Content at our discretion.

MEDIA COVERAGE AND EVENT CONTENT 

The Site may feature photos, videos, interviews, event recaps, and other media coverage involving hosts, guests, attendees, venues, sponsors, and members of the public.

If you participate in or attend a Surviving a Sagittarius event, recording session, interview, or media-covered activity where notice is provided that recording may occur, you acknowledge that your name, image, voice, likeness, statements, or participation may be captured and used in connection with the brand and show, subject to applicable law and any separate release you may sign.

If you believe content on the Site misidentifies you or was posted without appropriate authorization, contact us using the information below.

PROHIBITED CONDUCT 

You agree not to:
(a) violate any law or regulation;
(b) interfere with Site security or operations;
(c) attempt unauthorized access to systems or accounts;
(d) scrape, harvest, or collect data without permission;
(e) upload malware or harmful code;
(f) impersonate another person or entity;
(g) use the Site to harass, abuse, threaten, or defame others; or
(h) use our intellectual property without authorization.

THIRD-PARTY LINKS AND SERVICES 

The Site may contain links to third-party websites, social platforms, ticketing services, payment processors, or other services. We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is governed by their terms.

DISCLAIMER OF WARRANTIES 

THE SITE, MERCHANDISE, CONTENT, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

We do not guarantee uninterrupted access, error-free operation, or that defects will be corrected.

LIMITATION OF LIABILITY 

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SURVIVING A SAGITTARIUS AND ITS OWNERS, HOSTS, AFFILIATES, EMPLOYEES, CONTRACTORS, AND CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SITE, CONTENT, MERCHANDISE, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE, CONTENT, MERCHANDISE, OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

Nothing in these Terms limits liability that cannot be limited under applicable law.

INDEMNIFICATION 

You agree to defend, indemnify, and hold harmless Surviving a Sagittarius and its owners, hosts, affiliates, employees, contractors, and contributors from claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your User Content, your violation of these Terms, or your violation of any rights of another person or entity.

TERMINATION 

We may suspend or terminate access to the Site at any time, with or without notice, for conduct that we believe violates these Terms, harms other users, harms the brand, or creates legal or operational risk.

GOVERNING LAW 

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of those courts.

1. ENTIRE AGREEMENT 

These Terms, together with any posted policies referenced herein (such as a Privacy Policy and Returns/Refund Policy), constitute the entire agreement between you and Surviving a Sagittarius regarding the Site and supersede prior understandings relating to the Site.

SEVERABILITY 

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
